A judge has dropped charges against President-elect Donald Trump in the D.C. case against him after special counsel Jack Smith filed a motion Monday.

The decision concerns the investigation into the breach of the US Capitol on January 6th. Fox News Digital learned of Smith’s request on Monday.

“The government has moved to dismiss the superseding indictment without prejudice,” U.S. District Judge Tanya Chutkan wrote in a ruling. “The defendant does not object to the motion … and the court will grant it.”

Smith also filed a motion to withdraw his appeal in his case against Trump, which was dismissed by Federal Judge Aileen Cannon in July. Cannon ruled that Smith was improperly appointed as special counsel.

The moves come after Smith signaled earlier this month that he would begin dropping his case against Trump following Trump’s victory in the 2024 presidential election. The file was released to the Justice Department’s file on Monday afternoon.

Smith had already filed a motion to vacate all deadlines in the 2020 election interference case against Trump in Washington, DC – a widely expected move that did not result in the case against Trump being dropped entirely. Smith had said his team planned to provide an updated report on the official status of the Trump case on December 2nd.

Trump pleaded not guilty to all charges in the case and took up the fight the US Supreme Court, argues on the basis of presidential immunity.

The Supreme Court ruled that Trump was immune from presidential acts, forcing Smith to file a new lawsuit. Trump also pleaded not guilty to these new charges. Trump’s lawyers have sought to drop election interference charges in Washington, D.C., on the grounds that Smith was unlawfully appointed.

Trump pleaded not guilty to all charges related to Smith’s investigation.

Smith is expected to step down as special counsel before Trump takes office.

Trump posted on Truth Social Monday afternoon that the cases against him are “empty, lawless and should never have been brought.”

“These cases, like all the other cases I have had to go through, are empty and lawless and should never have been brought. Over $100 million in taxpayer money was wasted in the Democratic Party’s battle against its political opponent. “ME,” Trump posted. “There has never been anything like this in our country.”

Trump said: “Prosecutors and district attorneys like Fani Willis and her lover Nathan Wade (who had absolutely no experience in cases like this but were paid MILLIONS, enough to take numerous trips and cruises around the globe!), Letitia James, who inappropriately, unethically and probably illegally campaigned for “GETTING TRUMP” to win political office, and Alvin Bragg, who himself never wanted to bring this case against me, but did forced to do so by the Justice Department and the Democratic Party.”

Trump added: “It was a political hijacking and a low point in our country’s history that something like this could have happened, and yet, against all odds, I persevered and WON. MAKE AMERICA GREAT AGAIN!”
